§ 1 Scope of Application and Contractual Partners
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between cerascreen GmbH Güterbahnhofstr. 16 D-19059 Schwerin (hereinafter referred to as "cerascreen" or "we") and you as a customer (hereinafter referred to as "customer") via our online shop under http://www.cerascreen.co.uk.
(2) The customer within the meaning of these GTC is the consumer (§ 13 BGB).
(3) Our General Terms and Conditions for End Customers do not apply to orders placed by companies, but rather the applicable statutory provisions, in particular the German Civil Code (BGB) and the German Commercial Code (HGB). By ordering through our partner programs, you declare that you are acting as an entrepreneur. The contractual relationship is thus subject to the statutory provisions of the German Civil Code (BGB) and HGB, in particular with regard to delivery, payment, liability for defects and delay. Please note: Consumer rights according to §§ 312 et seq. BGB do not apply in this business area.
(4) A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his self-employed professional activity.
(5) An entrepreneur is a natural or legal person or a partnership with legal capacity which, when concluding a legal transaction, acts in the exercise of its commercial or self-employed professional activity.
(6) We shall only recognise deviating or conflicting terms and conditions of the customer if we have expressly agreed to them in writing.
§ 2 Conclusion of the contract, storage of the text of the contract
(1) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the customer to order goods.
(2) By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract by successfully completing the order procedure provided for in the online shop. The order is placed in the following steps:
- 1. Select the items you want.
- 2. Summary in the shopping cart and press the "checkout" button.
- 3. Entering billing and delivery data.
- 4. Selection of payment and shipping method.
- 5. Re-check or correction of the respective entered data and binding submission of the order by pressing the "Buy now" or "Pay now" button, a correspondingly clear designation.
(3) The contract is only concluded upon our acceptance of the offer. Acceptance takes place by means of a separate written confirmation, in text form (e.g. by e-mail) or by sending the ordered goods within five working days of receipt of the order. The automatically generated e-mail confirmation of receipt of the order does not yet constitute acceptance.
(4) Acceptance is subject to timely and complete self-delivery by our suppliers. This reservation only applies in the event that we are not responsible for the non-delivery, in particular if we have entered into a congruent hedging transaction with the supplier in good time. We will inform the customer immediately of the unavailability of the service. In the event of withdrawal, the customer's consideration will be refunded immediately.
(5) Storage of the contract text: We will send you the order data and our terms and conditions by e-mail. Your order data is no longer accessible via the Internet for security reasons.
§ 3 Prices, shipping costs, payment and due date
(1) The prices quoted include the statutory value added tax and other price components. In addition, there are any shipping costs, which will be shown separately.
(2) The customer can pay by PayPal, credit card, online bank transfer, Google Pay or Apple Pay. We reserve the right to limit the selection of payment methods depending on order value, shipping region or other factual criteria.
(3) Payment of the purchase price is due immediately upon conclusion of the contract, unless another method of payment has been agreed (e.g. payment on account).
(4) cerascreen is entitled to use trusted third parties to process the payment of the services. In the event of default of payment by the customer, we may assign our claims to a collection agency for enforcement and transmit the personal data required for payment processing to this third party. In relation to cerascreen, the payment shall only be deemed to have been made when the amount has been made available to the third party in accordance with the contract.
§ 4 Delivery and Transfer of Risk
(1) Unless otherwise stated in the product description, the delivery time is usually two to five working days after receipt of payment.
(2) Delivery shall be made to the delivery address specified by the customer.
(3) The risk of accidental loss and accidental deterioration of the goods shall not pass to the consumer until the goods are handed over. In the case of the entrepreneur, the risk passes to the customer when the goods are handed over to the freight forwarder, carrier or other person designated to carry out the shipment.
§ 5 Retention of Title
We reserve title to the goods until the purchase price has been paid in full. If the customer is an entrepreneur, we reserve ownership of all delivery items until receipt of all payments from the entire business relationship.
§ 6 Statutory Liability for Defects (Warranty)
(1) The statutory liability for defects (warranty) of the Federal Republic of Germany shall apply.
(2) For consumers: The limitation period for statutory claims for defects is two years from the date of delivery of the goods.
§ 7 Limitation of Liability
(1) cerascreen shall always be liable for damages resulting from injury to life, limb or health in accordance with the statutory provisions.
(2) cerascreen is only liable for other damages in the event of intent or gross negligence.
(3) In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), cerascreen's liability shall be limited to the amount of the foreseeable damage that typically occurs. Essential contractual obligations are those whose fulfilment is essential for the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely.
(4) Liability under the Product Liability Act shall remain unaffected by the above provisions.
(5) Insofar as cerascreen's liability is excluded or limited, this also applies to the personal liability of cerascreen's employees, employees, employees, representatives and vicarious agents.
§ 8 Right of withdrawal of the consumer

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the last goods.
In order to exercise your right of withdrawal, you must inform us (cerascreen GmbH, Güterbahnhofstr. 16, D-19059 Schwerin, e-mail: contact@cerascreen.com, fax: 0385 3993 521, telephone: +49 385 74139002) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the attached model withdrawal form for this, but it is not mandatory.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. Here you will find a sample withdrawal form.
Consequences of revocation
If you withdraw from this contract, we must reimburse you all payments we have received from you, with the exception of the delivery costs for the return shipment and additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us, without undue delay and at the latest within fourteen days from the day, on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen day period.
You will bear the direct costs of returning the goods.
They only have to pay for any loss in value of the goods if this loss of value is due to handling of them that is not necessary to check the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal for test kits and dietary supplements
The right of revocation does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery (Section 312g (2) No. 3 BGB). This applies in particular:
- cerascreen test kits after removal of the hygienic seal, as they are used for sample collection and must not be put back on the market.

Additional 30-day contractual right of return (goodwill)
Regardless of your legal right of withdrawal, we also grant you as a customer a 30-day right of return from receipt of the goods. This right of return only applies if the goods are unopened and sealed and are not affected by the legal reasons for exclusion (e.g. unsealed test kits). The conditions of the 30-day return policy are as follows:
- The period begins upon receipt of the goods.
- For all returns within the scope of this goodwill return policy, the customer bears the direct return costs.
§ 9 Contract Language, Choice of Law and Place of Jurisdiction
(1) Only German shall be available as the language of the contract.
(2) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies to consumers only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has his habitual residence.
(3) The place of jurisdiction for merchants, legal entities under public law or special funds under public law is Schwerin. In this case, cerascreen is also entitled to sue the customer at cerascreen's court of residence, at cerascreen's discretion.
(4) Consumers shall be subject to the legal place of jurisdiction at the customer's place of residence.
§ 10 Data protection
cerascreen processes the customer's personal data for a specific purpose and in accordance with the legal provisions, in particular the General Data Protection Regulation (GDPR).
Note: Consent to the processing of health data (such as test results) may not be given in general terms and conditions. Consent must be obtained separately, voluntarily, informed, specifically and unambiguously (Art. 9 para. 2 lit. a GDPR in conjunction with Art. 7 GDPR). Please ensure that a GDPR-compliant process for obtaining consent outside of these GTC is implemented for the processing of sensitive data.
To the Privacy & Data Protection
§ 11 Customer Service and Other Provisions
(1) Should individual provisions of these GTC be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the statutory provision.
